5K RACE PARTICIPANT WAIVER AND RELEASE OF LIABILITY
In consideration of being allowed to participate in the [2025 PMASD Carabao 5K] 5K Race (the “Event”) on [October 5, 2025], I, the undersigned participant, hereby agree to the following terms and conditions:
1. Acknowledgment of Risk: I understand that running in a 5K race involves inherent risks, including but not limited to, the potential for serious injury or death, accidents, falls, contact with other participants, and weather conditions. I acknowledge that these risks are part of the activity and I voluntarily assume all responsibility for such risks.
2. Medical Certification: I confirm that I am medically able to walk or run the required distance within the time limits stated herein. I agree that it is my responsibility to consult with a physician before participating in the Event if I have any concerns about my health or fitness level.
3. Release and Waiver: I, on behalf of myself, my heirs, executors, and administrators, hereby release and hold harmless [Philippine Medical Association of San Diego], [PMASD Carabao 5K] sponsors, volunteers, employees, agents, and any other parties involved in the organization and operation of the Event from any and all liability, claims, demands, actions, or causes of action arising out of or related to my participation in the Event, including but not limited to injury, death, or property damage, even if caused by the negligence of the released parties.
4. Indemnification: I agree to indemnify and hold harmless the Event organizers and all related parties from any claims, damages, or expenses, including attorney fees, arising from my participation in the Event or my violation of any rules or regulations.
5. Medical Treatment: In the event of an emergency, I consent to any medical treatment deemed necessary by medical personnel, and I agree to assume all costs related to such treatment.
6. Use of Image: I grant permission to the Event organizers and their agents to use photographs, videos, or other media taken during the Event for promotional purposes, including advertising, social media, or any other use without compensation to me.
7. Rules and Regulations: I agree to abide by all rules, regulations, and instructions set forth by the Event organizers, including any specific health and safety guidelines. I understand that failure to comply with the Event rules may result in disqualification.
8. Governing Law: This waiver and release shall be governed by and construed in accordance with the laws of the state of [State], without regard to its conflict of laws principles.
By signing below, I acknowledge that I have read, understood, and voluntarily agree to the terms and conditions of this waiver. I understand that this waiver is binding and that I am relinquishing certain legal rights by signing it.
